Processing of personal data

Law firm JUDr. Martin Repáň, advokat s.r.o. , with registered office at Mamateyova 12, 851 04 Bratislava, Slovak Republic, ID No: 36 861 502, is a legal entity registered in the Commercial Register of the District Court Bratislava III, Section: Sro, File No: 63879/B (hereinafter referred to as “ Attorney“), possessing authorization to provide legal services pursuant to the law on advocacy. The Attorney hereby, based on Article 12 of the General Data Protection Regulation, provides the data subject with information regarding the processing of personal data:

1. In connection with the provision of legal services, the Attorney processes personal data of the data subject. The Attorney does not process your data on its own initiative, but because it is required by applicable legal regulations.

2. In case the subject of legal service involves:
a) representation in judicial or administrative proceedings: The Attorney processes your data to the extent of (name, surname, title, date of birth, permanent address, email, telephone number). In this case, the provision and processing of data are a legal requirement;

b) acquisition or disposal of real estate: The Attorney processes your data to the extent of (name, surname, maiden name, title, date of birth, personal identification number, permanent address, email, telephone number, nationality). In this case, the provision and processing of data are a legal requirement;

c) your defense in criminal proceedings: The Attorney processes your data to the extent of (name, surname, maiden name, title, date of birth, personal identification number, permanent address, email, telephone number, nationality, content of criminal record excerpt). In this case, the provision and processing of data are a legal requirement. Processing of the content of the criminal record excerpt is not a legal requirement, but this data may be part of the investigation or court file;

d) establishment of a commercial company, acquisition of participation in a commercial company, or change in the governing and supervisory bodies of a commercial company: The Attorney processes your data to the extent of (name, surname, title, date of birth, personal identification number, permanent address, email, telephone number, nationality, type and number of identity document). In this case, the provision and processing of data are a legal requirement;

e) recording relevant facts in the Register of Public Sector Partners: The Attorney processes your data to the extent of (name, surname, title, date of birth, personal identification number, permanent address, email, telephone number, nationality, professional position within the governing/supervisory bodies of a commercial company, or position in the top management structure). In this case, the provision and processing of data are a legal requirement;
f) drafting a legal act document: The Attorney processes your data to the extent of (name, surname, title, date of birth, permanent address). In this case, the provision and processing of data are a contractual requirement;
g) legal act associated with the provision or receipt of funds: The Attorney also processes your data to the extent of IBAN and SWIFT. In this case, the provision and processing of data are a contractual requirement;

3. For the purpose of fulfilling its obligations in the field of combating money laundering and terrorism financing, the Attorney is authorized to process necessary personal data by copying, scanning, or otherwise recording official documents onto information carriers.

4. Providing data is a condition for the proper provision of legal services. If the nature of the legal service allows it, in case of refusal to provide data, the legal service will be provided to you to a limited extent, i.e., without data.

5. The Attorney does not disclose your data to third parties except when such obligation arises from applicable legal regulations or when requested by the competent state authorities to provide data.

6. Purposes of processing. The Attorney processes data for the purpose of providing legal services.

7. Legal basis for processing. The Attorney processes data based on the law, especially the Law on Advocacy, the Personal Data Protection Act, the Civil Procedure Code, the Extra-judicial Civil Procedure Code, the Administrative Procedure Code, the Commercial Register Act, the Anti-Money Laundering Act and the Terrorist Financing Act, Regulation (EU) 2016/679 of the European Parliament and of the Council.

8. Recipients/categories of recipients. The Attorney provides data to the following entities:
a) state administrative bodies;
b) local self-government bodies;
c) judicial authorities;
d) contracting party, provided that the subject of the legal service is the preparation or revision of a contract between the data subject and its contractual partner;
e) accounting services provider (to the extent of name, surname, permanent residence, date of birth) in case the data subject is a client of the Attorney.

9. Transfer of data to third countries. The Attorney does not foresee the transfer of data to countries outside the EU territory or to OECD countries and the USA under the EU/US Privacy Shield regime (the country according to the decision of the European Commission ensures an adequate level of data protection).

10. Data retention period. The Attorney retains data until the moment (whichever occurs later):
a) expiration of the warranty period for possible defects in the provided service;
b) expiration of the data retention period determined by the obligated person in the field of anti-money laundering and terrorism financing;
c) expiration of the data retention period determined by the Attorney in the field of accounting and archiving regulations.

11. Right to request access to data. You have the right to request from the Attorney to inform you whether and what data about you it processes. In case of data processing by the Attorney, you have the right to additional information to the extent of:
a) purposes of processing
b) categories of data
c) recipients of data
d) expected data retention period
e) existence of the right to request from the controller rectification, erasure, or restriction of data processing
f) right to lodge a complaint with the supervisory authority
g) source of data acquisition
h) existence of automated decision-making including profiling
i) data transfer to third countries

12. Right to request rectification and supplementation of data. You also have the right to request from the Attorney to correct the data it holds about you. With regard to the purpose of processing, you also have the right to supplement the data.

13. Right to erasure of data, right to restriction of data processing. You have the right to request from the Attorney to erase your data. You also have the right to request from the Attorney (if there are legal prerequisites) to restrict the processing of data. None of these rights supersedes the legal obligation of the Attorney to process your data to the extent and for the purpose stipulated by applicable legal regulations.

14. Right to data portability. You have the right to request from the Attorney to provide the data it processes about you to another attorney (or another controller with an equal legal obligation to protect confidential client information) in a structured, commonly used, and machine-readable format.

15. Right to lodge a complaint. In case of Attorney’s actions in the field of data protection, you have the right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic, with its registered office at Hraničná 12, 820 07, Bratislava 27, Slovak Republic, Email: statny.dozor@pdp.gov.sk, Tel. +421 2 323 132 14.

16. The Attorney does not engage in automated decision-making or profiling of data.

17. Security of electronic communication. Please be aware that email communication is not secure! For secure data transfer, the Attorney uses encrypted communication tools. For this purpose, deliver your public key to the Attorney in *.asc format through a secure channel.
